Want to work on challenging and innovative legal issues that require strategic and creative thinking, for a law firm that cares about improving health care delivery, privacy, security, and technology? You’ll be responsible for negotiating and drafting information technology and healthcare agreements, advising clients on current privacy and security frameworks and requirements as well as data use and data sharing across multiple jurisdictions, and advising clients on healthcare laws that impact provider contracting and healthcare services. You’ll have the opportunity to expand your knowledge and work on cutting-edge legal issues that impact people in their daily lives. You must have a JD degree from an ABA accredited law school, be admitted to practice law in the state where you are physically present, and have 5+ years of relevant legal experience.
*What We’re Looking For*:
At Melnik Legal we hire talented people based on their accomplishments, intellectual curiosity, and a strong alignment with our core values. We’re looking for someone who has a strong desire and demonstrated capability to work on complex healthcare technology and data privacy and security legal matters, in a regulatory environment that is changing daily. This role is for an independent contractor position that may become a full-time salaried role after a period of working together (should both parties so desire). Compensation will be commensurate with experience handling the type of matters handled by our firm, your existing access to resources (i.e., Westlaw, LexisNexis, or Bloomberg Law), and whether you maintain your own malpractice insurance.
We hire and evaluate from our Core Values - does this describe you:
- Quality is Job #1: I always strive for the best result through superior effort. I embrace the “measure twice, cut once” principle.
- I Own It: I reject a “that’s not my job” mentality. I pitch in, help out, and solve problems collaboratively. I do whatever it takes to get the job done.
- Mistakes to Mastery: I know mistakes happen. When they do, I acknowledge and learn from them. I pursue growth and learning daily.
- Positive and Professional: I cannot always control what happens. I can and will control how I respond. I always strive to have a positive mindset.
- 1% Rule: I am always looking for ways for the firm to improve. I embrace change.
- Excellent Client Experience: At the conclusion of the engagement, the client will return to us for future legal assistance and confidently refer their colleagues.
*Responsibilities*:
- Provide excellent client service, including meeting deadlines.
- Review, revise, draft, and negotiate a variety of contracts, including in the areas of healthcare, information technology, and data privacy and security.
- Draft contract provisions to the specific transaction and client’s unique needs.
- Monitor developments in federal and state healthcare (Anti-Kickback Statute, Stark, physician fee splitting) and privacy and security laws (HIPAA, NIST, state data breach notification laws) and provide legal advice to clients in a way that will allow them to operationalize the obligations.
- Review and respond to correspondence from clients, opposing counsel, and regulators in a professional manner and using all common business channels (e.g., email, telephone, meetings, video calls, screen sharing, and the like).
- Provide input on creating and improving the Firm’s systems, processes, and procedures to best serve the Firm’s clients.
- Maintain, update, and manage the client file, transaction status, tasks, and your time using the Firm’s practice and document management systems.
*Requirements*:
- Juris Doctor (J.D.) degree from an ABA accredited law school
- Be admitted to the Bar in the state where you are physically present
- 5+ years of legal experience in handling healthcare and information technology transactions
- Strong academic background with excellent communication skills (written and verbal)

- Be comfortable working remotely and in a small law firm environment
- Strong technology skills and ability and desire to learn new software systems quickly
- Possess excellent legal research and analysis skills, with high attention to detail and accuracy
