What you will do:
The Litigation Counsel is responsible for providing a wide range of in-house legal services for eXp Realty, LLC. Primary areas of focus to include: managing litigation, including conferring with outside counsel; developing litigation strategy; determining settlement value; facilitating outside counsel in responding to discovery requests; providing advice concerning legal issues that arise during real estate transactions and operation of a real estate brokerage; analyzing and responding to or drafting demand letters, cease and desist letters and other similar correspondence, facilitating compliance with regulatory requirements; responding to or assisting in the response to regulatory complaints; contract review and administration; and assisting with compliance and training.
This role requires a strategic thinker with strong attention to detail and significant experience collaborating with a variety of operational groups in a fast paced environment of innovation. A qualified candidate must be able to operate with a high case volume and efficiently shift attention between lower value and higher value matters.
Performance driven accountability of litigation matters for the company with the ability to work collaboratively, manage independently and overcome obstacles to produce results in a timely fashion.

Judge the merits of claims and court cases filed against or on behalf of the company, work with the appropriate business partner(s) to define a strategic litigation approach, and approve settlements of disputes where warranted.

Oversee the selection, retention, management, and evaluation of all outside counsel.

Provide strategic and proactive legal advice and counseling.

Develop and maintain strong business relationships as a key relationship manager for the legal department among the various internal business groups requiring litigation support.

Provide a balanced and integrated perspective of both business and law, while advising the company on litigation risks of possible business decisions and managing litigation.

Demonstrate team-working skills in support of a collaborative environment.

Provide technical advice to paralegals and other legal staff as needed.

Provide legal guidance and advice on the interpretation, implementation, and administration of policies and procedures; draft memoranda, and legal documents as needed.

Prepare responses to complaints/claims filed with federal, state, and/or municipal agencies or courts, as well as third-party organizations.

Perform legal research, analyze, organize, and strategize effectively.

Contribute to litigation team efforts to improve internal process and efficiency.

Exercise discretion and independent judgment commensurate with specialized legal skills and experience.

Directly handle and/or assist in monitoring, reviewing, and coordinating the activities involving management of both insured and uninsured claims, including analysis of coverage issues, establishment of adequate reserves, and the resolution and closure of claims.

Manage litigation with Preferred Counsel under Alternative Fee Arrangements or other defense fee structures.

Pursue and maximize all risk transfer opportunities by contract or by insurance policy language.

Assign and manage work of defense counsel when needed.

Assist with evaluating and determining liability and damages and actively participates in settlement negotiations.

Ensure proper file setup, reserving, loss contingency reporting, general handling and application of company procedure.

Participate in developing claims handling strategy, including defense coordination, litigation strategy and budgets, and expense control.

Record specific claims information and reports as appropriate to a manager relative to pertinent financial and general statistical records.

Maintain diary control, investigates, analyzes, and reports to ensure maintenance of proper reserves to reflect the company’s exposure and provides notice to insurers.

How you will grab our attention:
Juris Doctorate from a law school accredited by the American Bar Association

Admission to at least one state bar and currently in good standing.
-
3+ years experience in a law firm environment as a practicing litigation attorney, preferably with a regional or national law firm before moving to an in-house position.

Experience managing a high caseload with competing priorities
-
In-court experience and representing clients in mediation.
-
Familiarity with electronic discovery, including systems for preservation, collection, review and production of ESI in litigation.

Prior experience in real property law, including residential real estate transactions, business law, agency law, and contract law.

Experience with cost-effective management of outside legal resources.
-
Prior experience in advising clients on various options in litigation and providing recommendations based on the client’s goals and cost required for each option.

Strong leadership and communication skills – written and verbal - to work with senior executives across various geographies and functions; comfortable in business and technical discussions.

Ability to make recommendations and difficult decisions to implement best practices.

Experience drafting and revising legal documents and preparing policies and procedures.

Ability to manage competing priorities.

Strong analytical skills to work on complex business issues with minimum supervision.

Strong research and analysis skills.

Ability to adapt quickly and learn new tasks independently.

Results driven with the ability to meet deadlines.

Computer skills in Google and Microsoft products. Familiarity with Trello is a plus. Overall comfort with technological resources a must.

Ability to work independently and in ambiguous situations.
Experience working with HUD or CFPB and with such consumer regulations as RESPA and GLBA a plus.
